Trademarks are signs used to identify goods and services. To make sure, your trademark is not infringed, it is recommended to search registered trademarks. Generally speaking, all signs similar or identical protecting similar or identical goods and services may pose a threat.
In this context, it appears relevant to know that most national patent- and trademark offices as well as the European Union Intellectual Property Office (EUIPO) and the World Intellectual Property Organization (WIPO) do not carry out any examination research.
LHIP offers research services of word marks and figurative marks. Our customers define the research strategy. However, we offer adequate support in finding the right search parameters.
Word marks are searched by similarity search¹ in the relevant classes for goods and services (Nizza Classification). We do not recommend identity search, as infringement can also be based on similarity. Figurative marks are searched by the classification for figurative elements (Vienna Classification).
LHIP covers trademarks in more than 200 offices including trademarks, registered at the international organizations EUIPO and WIPO. Typically, all countries where our customers are/ plan to be active will be involved in the research strategy. We do not search genericized trademarks (protection of trademarks through intensive commercial use).
